Terms & Conditions

• It is understood Shots By Snikwah, LLC is the exclusive official photography company retained to perform the photographic services requested on this Agreement.

• Upon signature, Shots By Snikwah, LLC/Photographer shall reserve the time and date agreed upon. Unless the Studio is un-able to fully replace the cancelled reservation, all sitting fees and retainers are nonrefundable, even if the portrait is rescheduled or canceled for any reason other than inclement weather.

• If, in the opinion of the photographer, inclement weather or other adverse conditions prevent the creation of a portrait meeting the artistic standards of Shots By Snikwah/Photographer, Photographer may elect to use an alternate location or to reschedule the portrait.

• No part of any order, including previews, will be delivered until the balance is paid in full.

• Shots By Snikwah, LLC/Photographer reserves the right to use images created under this agreement for advertising, display, publication or other purposes. The Client signing this agreement warrants that he or she has actual authority to agree to the use of the likeness of all persons included in the portrait in this manner and shall indemnify and defend Shots By Snikwah, LLC/Photographer in the event of litigation arising out of such use. Negatives, digital files and previews remain the exclusive property of Shots By Snikwah, LLC/Photographer.

• Shots By Snikwah, LLC/Photographer may substitute another photographer to take the photographs in the event of Studio/ Photographer’s illness or of scheduling conflicts. In the event of such substitution, Shots By Snikwah, LLC/Photographer warrants that the photographer taking the photographs shall be a competent professional.

• If Shots By Snikwah, LLC/Photographer cannot perform this Agreement due to fire or other casualty, strike, act of God, or other cause beyond the control of the parties, or due to Photographer’s illness or emergency, then the Photographer shall return any deposit or sitting fee to the Client but shall have no further liability with respect to the Agreement. This limitation on liability shall also apply in the event that photographic materials are damaged in processing, lost through camera or media malfunction, lost in the mail, or otherwise lost or damaged without fault on the part of the Photographer. In the event Shots By Snikwah, LLC/Photographer fails to perform for any other reason, Shots By Snikwah, LLC/Photographer shall not be liable for any amount in excess of all monies paid.

• Client is aware that color dyes in photography may fade or discolor over time due to the inherent qualities of dyes, and Client releases Photographer from any liability for any claims whatsoever based upon fading or discoloration due to such inherent qualities.

• Client is permitted to have only one guest inside studio during shoot. Any other guest can wait outside in the provided seating area in then open mall area. In the event that the shoot is held after hours, guest will be asked to wait outside unless the Photographer gives permission that would allow guest to wait inside during shoot.

• The use of cell phone photography inside of studio is strictly prohibited. In the event that the Client or his/her guest takes a photo within the studio without permission from the Photographer, this agreement shall be terminated, and all sitting fees and retainers are nonrefundable.

• Minors are prohibited from the studio unless they are involved within the shoot. Studio equipment is expensive and can pose a threat of falling over causing serious injury or property damage. In the event that a minor(s) are permitted to be present inside the studio, it is the responsibility of the guardian to manage the minor(s). Shots By Snikwah, LLC/Photographer shall not be held liable for any injuries that shall arise while Client or his/her guest(s) are inside the studio.

• In the event that items become damaged by fault of Client or Client’s guest(s), Client accepts responsibility of damaged items regardless of if they are caused by accident. Payment for damaged equipment is required within seven days of incident. On the 7th day legal proceedings will begin.

• Client understands that the time starts at the agreed upon scheduled time. This is strictly enforced to remain fair to all Clients and their respected scheduled times. All sitting fees and retainers are nonrefundable, even if the portrait is rescheduled or canceled for any reason. Client(s) are allowed to show up at the studio ahead of time in order to start preparing for his/her scheduled time as long as they do not become distracting to any clients that may be present at that time.

• Change rooms and restrooms, all being private will be provided inside studio. Upon the scheduled time Client will find all agreed upon necessities inside of the designated change room.

• Appointments will be conformed 12 hours before clients agreed upon shoot. Failure to confirm at least 2 hours before the clients scheduled shoot time will result in shoot being canceled without deposit returned.

• The charges in this Agreement are based on the Shots By Snikwah, LLC’s/Photographer’s Standard Price List. This price list is adjusted periodically, and future orders shall be charged at the prices in effect at the time when the order is placed.

• NOTICE OF COPYRIGHT: It is ILLEGAL to copy or reproduce these photographs or videos elsewhere without Studio’s/Photographer’s permission, and violators of this federal law will be subject to its civil and criminal penalties.

•  This Agreement incorporates the entire understanding of the parties and is governed by the laws of Louisiana. Any modifications of this Agreement must be in writing and signed by both parties.
